This Regulations define the rules for making purchases on the online service available at www.maisondartgallery.pl. In the scope of services provided electronically, these Regulations constitute the regulations referred to in Article 8 of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2020, item 344 as amended).

§1 General Provisions

1.     The owner of the online store www.maisondartgallery.pl is Christophe Zerbone Investments, NIP: 5252481852, REGON: 362951249, with its registered office at al. Niepodległości 235/237/88, 02-009 Warsaw (hereinafter: "Seller").

2.     The Seller can be contacted:

•       by phone at: +48 575 640 001;

•       by email at: contact@maisondartgallery.pl.

3.     To use the website www.maisondartgallery.pl, including placing Orders, a device with an internet browser supporting HTML5 standard with web storage technology and an active internet connection is required.

4.     The Seller reserves the right to technical breaks necessary for the maintenance or expansion of the Service, about which Clients will be informed in advance, if possible.

§2 Definitions

The terms used in these Regulations mean:

•       Client – a natural person, legal person, or organizational unit without legal personality, having legal capacity, who places an Order in the Online Service under the terms specified in these Regulations.

•       Consumer – a Client who is a natural person using the Service for a purpose not directly related to their business or professional activity, as well as a natural person conducting a sole proprietorship, making a purchase unrelated to the nature of that activity (Article 38a of the Consumer Rights Act).

•       Object / Subject of Transaction – a work of art listed and described on the Online Service, which is the subject of the Sales Agreement.

•       Sales Agreement – a contract for the sale of Objects within the meaning of the Civil Code, concluded between the Seller and the Client via the Online Service.

•       Online Service (Service) – an online service available at www.maisondartgallery.pl, through which the Client can place an Order.

•       Order – a declaration of will by the Client, clearly specifying the type and quantity of Objects, directly aiming at concluding a Sales Agreement.

§3 Subject of Sale

1.     The Objects sold in the Service are works of art, in particular paintings and sculptures, obtained directly from their creators or acquired by the Seller.

2.     The Objects offered in the Service may show signs of age and possess individual characteristics. The Seller undertakes to inform Clients about the essential properties of the Objects and to deliver them without defects, excluding defects indicated in the sales offer.

3.     The offered Objects have been accepted for sale based on a consignment agreement or have been acquired by the Seller and are his property.

4.     Copyrights to the Objects, in particular the right to reproduce or commercially exploit them, are not covered by the sale. All copyrights remain with the creator or an authorized third party.

5.     A condition for accepting Objects into the Service is a declaration by the owner of the Object that the Object is original, is their property, and does not infringe the copyrights of third parties.

6.     The Service reserves the right to remove an Object if there is a reasonable suspicion that the declaration made is untrue. The Service is not responsible for hidden physical or legal defects of the Objects.

7.     The presented photos of the Objects may differ slightly from the original – especially in terms of color reproduction – due to individual monitor settings and photographic techniques.

8.     All photographs posted on the Service are the property of the Seller, unless otherwise indicated. Their use without the Seller's written consent is prohibited.

§4 Orders and Conclusion of Sales Agreement

1.     A condition for placing an Order is familiarization with these Regulations and acceptance of their provisions.

2.     Browsing the offer, asking questions, and making transactions do not require registration in the Service.

3.     All prices given in the Service are gross prices in Polish zlotys or other indicated currency. Prices do not include shipping costs, unless otherwise indicated.

4.     Orders are accepted via the website www.maisondartgallery.pl and at the email address: contact@maisondartgallery.pl.

5.     Orders can be placed 24 hours a day, 7 days a week, throughout the year, with the exception of technical breaks or internet failures resulting in no access to the Service.

6.     The Client is responsible for correctly completing the order form and providing up-to-date contact details, including a precise delivery address, phone number, and email address. In case of data change, the Client is obliged to update them with the next Order.

7.     If incorrect data provided by the Client causes damage to the Seller, the Seller has the right to charge the Client additional costs for this reason.

8.     The Client receives a fiscal receipt or – upon request made before the Order fulfillment – a VAT invoice, which can be attached to the shipment or sent electronically. Most Objects are sold under the VAT margin scheme.

9.     Placing an Order is equivalent to consenting to the processing of the Client's personal data to the extent necessary for the Order fulfillment, in accordance with the Privacy Policy available on the Service's website and GDPR provisions.

10.  After placing an Order, the Client will receive an automatic confirmation of its receipt via email.

11.  The Seller will confirm the transfer of the Order for fulfillment within 48 hours (excluding non-working days). This confirmation is equivalent to the conclusion of the Sales Agreement.

12.  The Seller reserves the right to withdraw from the fulfillment of an Order if it is impossible to perform, about which the Client will be immediately notified.

13.  If the Order confirmation period is extended, the Seller will immediately notify the Client, who may then withdraw from the Order.

14.  In case of withdrawal from the Order by either party, the Seller will return all payments made by the Client no later than within 14 days.

§5 Payment

1.     Payments for Objects and transport costs are made during the Order placement via the PayU system or by bank transfer (manual payment) to the indicated bank account number.

2.     Receipt of payment is a condition for the Seller to proceed with the Order fulfillment and dispatch of the Object.

3.     If payment by bank transfer is chosen, the Client is obliged to pay the amount due within 5 working days from the date of placing the Order. After this period, if payment is not recorded, the Order may be canceled.

§6 Delivery

1.     Purchased Objects are shipped within 14 working days from the date of payment posting, via a courier company. In exceptional cases, the deadline may be extended, about which the Client will be immediately informed.

2.     The Client bears the cost of delivery. The amount of fees is indicated in the Order in the "Delivery Method" section. In exceptional cases, the delivery cost is calculated individually upon the Client's request.

3.     The Seller is not responsible for loss or damage to Objects caused by the courier company. In case of discovering damage to the shipment, the Client should draw up a damage report in the presence of the courier.

4.     The Client may pick up the purchased Object in person, after prior agreement of the pickup conditions with the Seller.

§7 Returns and Complaints

1.     A Client who is a Consumer has the right to withdraw from a distance contract without giving a reason, within 14 days from the date of receiving the Object, in accordance with Article 27 of the Act of May 30, 2014, on consumer rights (Journal of Laws of 2020, item 287 as amended).

2.     To exercise the right of withdrawal, the Client is obliged to submit a relevant declaration of intent, addressing it to the email address: contact@maisondartgallery.pl or in writing to the Seller's registered office address. A model withdrawal form is an appendix to the Consumer Rights Act.

3.     The Object shall be returned immediately, but no later than within 14 days from the date of submitting the declaration of withdrawal. The Object must be returned in an unchanged condition, properly secured. At the Client's request, the Seller will provide instructions on how to properly pack the returned Object.

4.     Payment will be refunded within 14 days from the date the Seller receives the returned Object and confirms its condition, using the same payment method used by the Client, unless the Client agrees to a different form of refund.

5.     For domestic returns, the Seller refunds the Client the cost of return shipping up to the amount corresponding to the cheapest available shipping option.

6.     Return parcels can be sent via any courier company. In the case of returning original Objects (paintings, sculptures), prior consultation with the Seller regarding the form of security and transport is required. Parcels sent to a parcel locker, cash on delivery, or delivered in person without prior arrangement will not be accepted.

7.     The right to withdraw from the contract does not apply to Objects:

•       made to the Client's individual order (including Art Print);

•       adapted or processed at the Client's request, in particular framed or removed from a stretcher;

•       whose nature – after opening the packaging – prevents their return (Article 38 of the Consumer Rights Act).

8.     The Seller emphasizes that the Objects are individual works, often used and bearing traces of time, which is an inherent characteristic of original works of art. This circumstance is clearly communicated to Clients in the descriptions of the Objects.

9.     Complaints regarding the non-conformity of the Object with the contract can be submitted by the Client electronically to the address: contact@maisondartgallery.pl. The Seller will consider the complaint within 14 working days of its receipt and will inform the Client of the outcome via email.

1. The cost of return shipping is borne by the client.

§8 Personal Data Protection

1.     The administrator of Clients' personal data is the Seller. Data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and the Act of May 10, 2018, on personal data protection.

2.     Detailed rules for processing, storing, and using personal data and Clients' rights in this regard are specified in the Privacy Policy available on the Service's website.

3.     Every Client has the right to access their data, rectify it, erase it, restrict its processing, transfer it, as well as the right to object to its processing and lodge a complaint with the President of the Personal Data Protection Office (PUODO).

4.     Clients who have consented to receive the Newsletter may withdraw their consent at any time by clicking the unsubscribe link included in each message or by contacting the Seller.

§9 Final Provisions

1.     In matters not regulated by these Regulations, the provisions of the Civil Code, the Act on the provision of electronic services, the Consumer Rights Act, and other generally applicable provisions of Polish law shall apply.

2.     The Consumer has the right to use out-of-court complaint resolution and claim settlement methods, including the ODR platform available at: https://ec.europa.eu/consumers/odr.

3.     The Seller reserves the right to introduce changes to the Regulations. Clients will be informed about changes to the Regulations electronically at least 14 days in advance. Using the Service after the changes come into effect is equivalent to their acceptance.

4.     The Service respects the freedom of artistic expression guaranteed by Article 73 of the Constitution of the Republic of Poland and is not responsible for the content expressed by the exhibited Objects.
